Canada Family PR/Federal Skilled Worker Visa
The skilled worker class for Canadian permanent residence provides a route to Canadian immigration and permanent residency status for workers with desirable skills. Skilled migration to Canada depends on certain parameters and an applicant must score threshold points (67 points) under a points based assessment. If you do not qualify for this route to live and work in Canada permanently, you may be able to apply for a Canadian visa of an alternative class.
As a Canada-returned Lawyer, we can help you to determine which of the range of visas for Canada and Canadian work permits available is the right option for you. We provide everything you will require for your relocation to Canada, immigration expertise, detailed information on the processes of immigration and post landing services with job assistance.

Benefits
Applying for a Canadian skilled worker visa allows full access to the domestic job market without the need for a sponsoring employer, a Canadian work permit or a specific job offer. Unlike Canadian visit visas, often referred to as Tourist visas for Canada, this permanent Canadian visa for immigration places no restrictions whatsoever on working in the country. The company-specific conditions of Canadian working permits are by-passed and candidates are free to work without constraint, with the status of a permanent Canadian resident. After three years in the country a successful applicant may become a Canadian citizen.

Canada Work Permit
A work permit for Canada or Canadian work visa is a temporary Canadian immigration policy which allows a worker to migrate to Canada to fill a specific position in a particular company.
In Canada, work permits are not intended as a route to settlement and applications for visas of this kind are designed to help Canadian employers who are finding it difficult to fill positions with Canadian permanent residents or Canadian citizens.
Benefits
Applying for a Canadian working permit makes provision for working in Canada without the need to undergo a point based assessment. In Canada, skilled worker visas and Canadian business visas require certain point threshold to be met in order to qualify.
Canadian work permits allow you to work in the country; however, they are dependent upon a job offer from a sponsoring company.
Working permits are not transferable, although you can apply for a Canadian visa for immigration of another type during your stay. Whilst in Canada, immigration status can only be altered in this way so long as your permit is still valid.

Eligibility
A permit for working in Canada rests upon a written job offer from an employer.
Once you have received such an offer, in most cases it is then subject to confirmation by Human Resources and Skills Development Canada (HRSDC) who will assess the likely impact of employing a foreign national in the position in question, to ensure that the employment is genuine and that it will not impact negatively on the domestic labour market.

HRSDC
Once HRSDC confirms that job offers may be filled by foreign nationals, applicants may request Canadian working permits from Citizenship and Immigration Canada (CIC).
Foreign workers seeking to work in Quebec will also require authorization from the Quebec immigration authorities.
Employers sponsoring a foreign national for a work visa in this way are responsible for ensuring that the candidate is in possession of the necessary permits and that they adhere to the appropriate conditions and limitations.

Dependents
In Canada, visas of this type make provision for marriage immigration and spouse immigration on a temporary basis, and your husband, wife, or common-law partner and dependent children may join you.

Canada Visitor/Tourist Visa
Canadian visas of this type are required for nationals of some countries who wish to temporarily live in Canada in order to visit their relatives/friends/business associates and on tour purposes
A Canadian temporary resident visa , often referred to as a tourist visa or visitor visa for Canada, is a temporary Canadian immigration option allowing tourists to visit Canada for a maximum of six months.
A travel visa of this kind is required by nationals of some countries when visiting the country.
In Canada, visit visas of this kind are not intended as a route to settlement and do not offer permanent residence or the opportunity to apply for Canadian citizenship.
Visiting visas are issued on the understanding that you will not be permitted to work, and that you will depart on or before the expiry of your tourist/visitor visa.

Benefits
Applying for a Canadian visit visa is the appropriate method if you wish to enter the country purely for the purpose of visiting.
Visitor visas are the popular route for over 35 million visitors each year and will allow you to stay for a period of up to six months.
Applications for visit visas can be submitted for one of three categories.

Single entry Canada Visitor Visa
This category allows you to visit Canada once for the duration of no more than six months.
However, once in the country you can apply for a Canadian visa extension so long as you do so no later than 30 days before the expiry of the original document.

Multiple Entry Canada Visitor Visa
Under this category, you may enter and depart on several occasions during the validity of the Canadian travel visa.
In this case, you will need to specify the length of time you require. The length of time subsequently awarded will be decided by an issuing case officer.

Transit Canada Visa
The third category is intended for people entering the country en route to another destination who will be spending no longer than 48 hours in the country.

Eligibility Criteria
In order to meet the eligibility requirements for a visiting visa, you will need to demonstrate that you :
  • Possess sufficient funds to support you and your family for the duration of your visit.
  • Do not intend to seek or undertake employment.
  • Have no criminal record and intend to abide by the laws of the country.
  • Pose no security risk.
  • You may also be required to complete a medical examination.

Working and studying in Canada
Whilst in the country on any of the above tourist visas it is not permitted to undertake employment.
If you wish to work during your time in the country, you will need an accompanying Canadian work permit. You may study so long as the course is short term and will not exceed the six months expiry date.

Spouses and Dependants
Spouse immigration or fiancé immigration are not specifically provided for under this route and your spouse, common law partner and dependent children over 18 years of age will need to apply for their own visiting visas and meet the appropriate criteria.

Arranged Employment, as a selection factor, awards points in the case that a Canadian employer satisfies Human Resources and Skills Development Canada (HRSDC) that a bona-fide offer of skilled employment exists for a candidate upon becoming a permanent resident of Canada.
The main advantage of Arranged Employment is that it greatly reduces the delays inherent in the Permanent Residency application process. However, the applicant cannot come to live and work in Canada until the Canada Immigration Visa is issued.
